Welcome to Potty Grass Malaysia. Please read these Terms and Conditions ("Terms", "Agreement") carefully before using our website or subscribing to our fresh grass delivery services ("Services").

This website and its related services are operated by Potty Grass Malaysia. Throughout the site, the terms "we", "us" and "our" refer to Potty Grass Malaysia. By visiting our site, purchasing our products, or starting a recurring subscription, you agree to be contractually bound by the following terms, including those additional terms, conditions, and disclaimers referenced herein or available by hyperlink.

1. Sole Proprietorship Structure & Absolute Personal Asset Protection

You explicitly acknowledge and agree that Potty Grass Malaysia is legally structured and operated as a sole proprietorship under Malaysian law.

To the maximum extent permitted by the Malayan Contracts Act 1950 and all applicable local laws, you contractually agree that the owner, or any associated family members, employees, or operational agents, shall have zero personal liability for any business debts, legal judgments, or claims. By executing a transaction on this platform, you permanently waive any right to claim damages against, freeze, or pursue the personal estate, private bank accounts, real estate properties, vehicles, or private assets of the owner.

2. Comprehensive Limitation of Liability

In no event shall Potty Grass Malaysia or its owner be liable for any indirect, incidental, special, exemplary, or consequential damages whatsoever. This absolute cap includes, but is not limited to:

  • Any damage to your property, flooring, balcony structural elements, or drainage systems.

  • Any landlord, building management, or strata council disputes arising from your placement or usage of our grass box.

  • Any secondary expenses, medical bills, or financial losses associated with your pet’s behavior or interaction with the product.

Our maximum, absolute aggregate financial liability to you for any dispute, breach, claim, or lawsuit shall be strictly capped at the exact total amount you paid to us for the specific individual order or subscription delivery cycle that caused the dispute.

3. Natural Product, Live Agricultural, and Safety Disclaimers

We supply 100% natural, real living grass sod. Because this is a live agricultural product, you explicitly agree to the following terms:

  • Natural Variation: Variations in grass color, thickness, blade height, soil moisture content, and overall lifespan are completely normal. We supply our products strictly "as is" and "as available" without any express or implied guarantees that the grass will remain green or alive for a specific duration.

  • Microscopic Organisms and Insects: While we perform regular quality controls, living sod naturally contains organic matter and may host standard outdoor micro-organisms, tiny insects, or soil-borne bugs. We are not responsible for any household or balcony insect presence resulting from our natural product.

  • Pet Supervision and Ingestion: It is your sole responsibility as a pet owner to supervise your animal when they are using the Potty Grass box. We are completely absolved of liability if your pet experiences illness, allergies, or gastrointestinal distress from chewing, digging up, or swallowing parts of the grass, roots, soil, or accompanying cardboard packaging.

4. Subscription billing, Modification, and Cancellation Terms

By selecting a recurring subscription plan, you authorize Potty Grass Malaysia to automatically bill your designated payment method at your chosen delivery frequency intervals.

  • Cancellation Window: To pause, cancel, or modify your subscription order, you must execute the change within your customer account portal or notify us via email at least 48 hours prior to your scheduled billing date.

  • Late Cancellations: If a cancellation or pause request is submitted after a recurring billing cycle has been processed, that cycle cannot be refunded or recalled, as your specialized fresh grass order will have already been reserved and cut for fulfillment.

5. Delivery, Shipping Logistics, and Building Access

We rely on local Malaysian third-party courier and logistics partners to deliver our products to your location.

  • Accurate Information: You are entirely responsible for providing an accurate, complete shipping address and contact number at checkout.

  • Condominium & Apartment Access: If you reside in a high-rise condominium, apartment, or gated community, you are responsible for ensuring that your building's management office or guardhouse allows courier delivery access. If a delivery fails because the courier is denied entry, or because you are unreachable, we maintain no liability, and no refunds or replacement boxes will be issued for that cycle.

6. Indemnification Clause

You agree to fully indemnify, defend, and hold harmless Potty Grass Malaysia, its owner, and operational partners from and against any and all claims, liabilities, damages, losses, costs, and legal fees (calculated on a full indemnity basis) arising directly or indirectly from your misuse of our products, your breach of any clause in these Terms, or your violation of any third-party rights.

7. Governing Law and Jurisdiction

These Terms and Conditions, along with your commercial relationship with Potty Grass Malaysia, shall be governed by, interpreted, and enforced strictly in accordance with the laws of Malaysia. Any disputes or legal proceedings arising directly or indirectly from this agreement shall be subject to the exclusive jurisdiction of the courts of Malaysia.
